Acceptance & eligibility
By accessing ciphercrm.co, requesting a demo, or using CIPHER CRM, you accept these Terms. You must be at least 18 years old and able to enter a binding contract, and - where you act for an organisation - authorised to bind that organisation. If you do not agree, do not use the service.
Description of service
In plain terms: CIPHER is an industry-specific CRM. What each plan includes can vary, and we keep improving it over time.
CIPHER CRM is an industry-specific customer-relationship-management platform for businesses - including pipelines, billing, task management and client management. Capabilities described on our industry and feature pages are illustrative and may vary by plan and deployment. We may improve, change or discontinue features over time.
Accounts & responsibilities
In plain terms: keep your login safe, give real details, and give each team member their own login. What happens under your account is your responsibility.
You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorised use. Each user should have their own individual login.
Acceptable use
In plain terms: use CIPHER for honest, lawful work. No hacking, no mass scraping, no illegal or harmful content.
You agree to use CIPHER CRM lawfully and not to misuse it - including no unauthorised access, no scraping at scale without permission, no interference with the service, and no unlawful, infringing or harmful content. See our Acceptable Use / Abuse and Anti-Spam policies, which form part of these Terms.
Subscription, fees & billing
In plain terms: paid plans are charged up front for the period you pick, and applicable taxes are on top unless we say otherwise.
Paid plans are billed in advance for the period you select, at the fees and on the terms presented at the time of purchase. Fees are exclusive of applicable taxes unless stated otherwise. You authorise us (or our payment processor) to charge the applicable fees for your subscription.
Renewals, cancellation & refunds
In plain terms: plans renew unless you cancel. Cancel any time and it stops at the end of the period you already paid for. Refunds follow our Refund Policy.
Subscriptions may renew for successive periods unless cancelled. You can cancel at any time to stop future renewals; cancellation takes effect at the end of the current billing period. Refunds, where they apply, are governed by our Refund Policy.
Intellectual property & trademarks
CIPHER CRM, the CIPHER and CIPHER Craft names, logos and all software and site content are owned by CIPHER Craft Pvt. Ltd. or its licensors, and are protected by law. You may not copy, modify or redistribute them without written consent. Use of our brand is governed by our Trademark Policy.
Customer data & our role
In plain terms: the data your team puts into the CRM stays yours. We just process it to run the service for you.
You retain ownership of the data you and your users upload into CIPHER CRM. For that data, you are the controller and CIPHER acts as a processor on your behalf, processing it to provide the service and under your instructions. How we handle personal data is set out in our Privacy Policy and GDPR & Data Protection page.
Third-party services & integrations
CIPHER CRM may connect with third-party services (for example WhatsApp, email or calendar tools). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and their availability may change.
Warranties & disclaimers
We provide the service with reasonable skill and care and aim for high availability. To the extent permitted by law, the service is otherwise provided "as is" and "as available", without other warranties. Information on the site may change without notice.
Limitation of liability
In plain terms: if something goes wrong, our liability is limited as far as the law allows - but we never limit what the law says we cannot.
To the maximum extent permitted by law, CIPHER Craft Pvt. Ltd. is not liable for indirect, incidental, special or consequential losses, or loss of profits, revenue or data, arising from your use of the service. Nothing in these Terms limits liability that cannot be limited under applicable law, including under India's consumer-protection laws.
Indemnity
You agree to indemnify CIPHER Craft Pvt. Ltd. against claims, losses and costs arising from your unlawful use of the service, your breach of these Terms, or content you upload that infringes the rights of others.
Suspension & termination
We may suspend or terminate access if you breach these Terms or use the service unlawfully, or as required by law. You may stop using the service at any time. On termination, provisions that by their nature should survive (such as IP, liability and governing law) continue to apply.
Governing law & dispute resolution
In plain terms: Indian law governs these Terms, and disputes go to the courts in Rajkot, Gujarat.
These Terms are governed by the laws of India. Subject to applicable consumer-protection rules, the courts of competent jurisdiction at Rajkot, Gujarat, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the service.
Changes to these Terms
We may update these Terms as the service or the law changes. The Effective and Last updated dates above show the current version. Material changes will be highlighted here and, where appropriate, notified to you. Continued use after changes take effect means you accept the updated Terms.
